September 4, 2026 - NHTSA Investigates Tesla CyberCab Launch

This is the Telemetry Transportation Daily for September 4, 2026, and I'm Sam Abuelsamid, Vice President of Market Research for Telemetry. 


This week, Tesla began deploying its purpose-built two-seat Cybercab on its Austin, Texas, Robotaxi service. Just hours later, the National Highway Traffic Safety Administration opened an investigation into Tesla's self-certification process for the CyberCab. Like the Zoox robotaxi, the CyberCab is designed to operate without any human controls, such as pedals and steering wheels in the vehicle that would enable a control takeover. When Zoox first publicly unveiled its vehicle in 2022, NHTSA launched a similar investigation because the absence of these control systems violates Federal Motor Vehicle Safety Standards. While regulators have proposed updating FMVSS to enable automated vehicles to run without these controls, that hasn't yet happened. Until it does, there is a process that allows companies to apply for an exemption that would allow deployment of up to 2,500 vehicles per year for two years. 


NHTSA initially allowed Zoox to operate its robotaxis as part of a demonstration program, which the Amazon-owned company launched in Las Vegas in 2025. As part of the program, Zoox only deployed a few dozen vehicles and did not charge for rides. In July, Zoox was granted the formal waiver and has since begun charging for rides in Las Vegas, with plans to expand to other cities, including San Francisco, Austin, and other locations. As far as we know, Tesla has not yet applied for an exemption and it's not clear if the company will. Tesla has a long history of flouting regulations. Given Tesla CEO Elon Musk's support and friendship with the current administration, it would not be surprising if NHTSA quickly provides at least a demonstration permit, if not the full waiver. NHTSA told Techcrunch that it is in the process of updated FMVSS rules to enable automated vehicles to be deployed without human controls and it will likely fast track this process to allow Tesla to deploy its vehicles. 


Tesla's vehicles still operate with a camera-only system, and videos are regularly posted by users of its full-self-driving software showing the vehicles making dangerous decisions. Without a multimodal sensor system, Tesla CyberCabs are unlikely to be as safe as competitors anytime in the foreseeable future.
